Environmental Review: The Initial Study prepared for this <br /> project identified two environmental effects with the poten- <br /> tial to be significant. One was the traffic and circulation <br /> effect as it related to the proposed project and to cumulative <br /> traffic conditions . Implementation of the mitigation measures <br /> indicated in a traffic study prepared by TJKM will reduce <br /> these potential effects to levels of nonsignificance. The <br /> other environmental issue related to the loss of prime agri- <br /> cultural land. Although the loss of 38 acres of prime farm <br /> land is not mitigable, this loss is considered negligible in <br /> relation to the amount of prime farm land within the County. <br /> On these bases , a Negative Declaration is recommended. <br /> General Plan Amendment and Zone Reclassification: The <br /> Planning Commission reviewed the General Plan amendment and <br /> rezoning applications at their regular meeting on March 17 , <br /> 1988 . Mr. Howard Seligman, representing the applicant, spoke <br /> in favor of the proposal . No one spoke in opposition After <br /> deliberation, the Planning Commission voted 6-0 to recommend <br /> approval of the amendment and rezoning. One concern of the <br /> Planning Commission was that development of the property would <br /> be restricted to airport-related uses under the provisions of <br /> a Development Agreement. <br /> Williamson Act Contract Cancellation: <br /> Contract History. The Williamson Act contract on the 74-acre <br /> parcel was entered into on December 28, 1976, and a Notice of <br /> Nonrenewal was issued on March. 1, 1984 . <br /> Findings. By State Law, the Board of Supervisors may grant <br /> tentative approval for cancelling a contract on Williamson Act <br /> property only if it makes one of the following findings: <br /> 1 . That the cancellation is consistent with the purpose of <br /> the Williamson Act; or <br /> 2 . That the cancellation is in the public interest. <br /> Each of these findings includes subfindings that also must be <br /> made by the Board. Staff has prepared subfindings under the <br /> first finding for Board consideration (Attachment A) . <br /> Alternative Use of Property. In submitting a petition for a <br /> cancellation request, the landowner is required by State Law <br /> to provide a proposal for a specified alternative use of the <br /> land. The level of detail shown in this proposal must be <br /> determined by the Board to be sufficient to permit them to <br /> make the required findings . A project description is included <br /> in the attached staff report which describes the Aero-Turbine <br /> proposal. <br /> BOS LETTER PAGE 2 <br />
