No Further Action Determination Site 8 -2 - 23 January 2004 <br /> Former NCTS Stockton, Rough and Ready Island <br /> analytical data from soil samples and waste extraction tests suggest that Site 8 soils were not the source <br /> of these groundwater contaminants and that remaining soil contaminant concentrations pose no <br /> significant threat to water quality. <br /> Based on the information presented in the Closure Report, and the NCTS Stockton case file, and with <br /> the provision that the information provided to this agency is accurate and representative of site <br /> conditions, this agency finds that appropriate actions have been completed and that no further remedial <br /> or removal actions are required for soils at Site 8. <br /> We understand that the Port will address contaminated groundwater beneath and in the immediate <br /> vicinity of Site 8 as part of an overall groundwater investigation and remediation strategy to be <br /> implemented at Rough and Ready Island in the future, as required, pursuant to the Consent Agreement. <br /> Nothing in this determination shall constitute or be construed as a satisfaction or release from liability for <br /> any conditions or claims arising as a result of past, current, or future operations at this location. Nothing in <br /> this determination is intended or shall be construed to limit the rights of any parties with respect to claims <br /> arising out of or relating to deposit or disposal at any other location of substances removed from the site. <br /> The Port has informed us of it's plans to begin re-development activities, including automobile processing <br /> activities, at the Site 8 location. If existing, additional, or previously unidentified chemical constituents at <br /> the site cause or threaten to cause pollution or nuisance or are found to pose a threat to public health or <br /> water quality, then 1) nothing in this determination is intended or shall be construed to limit or preclude <br /> the Board or any other agency from taking any further enforcement action, and 2) this letter does not <br /> relieve the Port of Stockton from any responsibilities mandated under the California Health and Safety <br /> Code and the California Water Code.
