We appreciate the Navy's efforts to coordinate on this transfer <br /> document. As indicated in the FOSET, additional environmental investigations and remedial activities <br /> will be necessary to address residual contamination that remains at levels that are not sufficiently defined or <br /> are above restricted use in a number of areas in the Phase III parcels proposed for transfer. The assessment <br /> of suitability for this early property transfer and the assurances and restrictions necessary to complete all <br /> response actions and to adequately protect human health and the environment are also based, in large <br /> part, on the Environmental Services Cooperative Agreement(ESCA)between the Navy and the <br /> transferee (The Port of Stockton) and the Consent Agreement between the State regulatory agencies and <br /> the Port of Stockton, currently under development. We consider the inclusion of these documents to be a <br /> critical part of completing the FOSET. We understand that the highlighted text referencing these <br /> documents will be appropriately changed and the final versions of these documents will be included in <br /> the final version of the FOSET, once the ESCA and the Consent Agreement have been finalized. <br /> As follow-up to our recent discussions with the Navy regarding the FOSET, we received a revised <br /> version of the Storage Tank and Oil Water Separator Inventory, Table 2 of the FOSET, which updates <br /> the closure status of each of the sites located on Phase III early transfer parcels. The Navy also provided <br /> us with additional information to further clarify the remedial status and location of all underground <br /> storage tank(LJST), above ground tank(AST), and oil/water separator (OWS) sites for the various <br /> parcels already transferred and for the proposed Phase III parcel transfer.
