In Port's review of this letter,the Port would like to point <br /> out the following clarifications in order to properly put the Port's position in context with regard to <br /> this matter: <br /> With regard to your fourth bulleted paragraph, you indicated, "The Port will direct the <br /> Constructing Party (CP) to immediately halt construction activities until further <br /> notice". As was previously surfaced by the Port,the Port does not believe it is in a <br /> position to halt construction activities due to Environmental and Regulatory issues. <br /> Instead, the Port's position is that, from a regulatory stand point, it is the Navy/Central <br /> Valley Regional Water Quality Control Board's (CVRWQCB) decision to halt the <br /> construction activities not the Port's. <br /> • Furthermore, you indicated, "The Port will in turn verbally notify the Navy/Board <br /> within 24 hours and follow-up with written correspondence within 7 days". Again, the <br /> Port is neither in a position, nor is the Port willing to assume the liability of being the <br /> regulator. Instead,the Port is willing to assume the role for being the conduit of <br /> information between the CP and the Navy/CVRWQCB. As the CP will specify in its <br /> construction documents that it is responsible to notify the Port, Navy, and the <br /> CVRWQCB if and when any contamination is encountered in the Navy's " clean" <br /> parcels.
