First, any construction project will be forwarded through <br /> the Port to the Navy/CVRWQCB for review and concurrence. Second, any and all <br /> contamination discovered by the CP, which may be attributed to the Navy, will be <br /> documented by the CP and its contractors/consultants and sent to the <br /> Navy/CVRWQC13 (with copies to the Port)to be included in the Navy's long term <br /> environmental liability obligation regarding the island. Once again, the Port is neither <br /> in a position nor believes it should assume any liability as a potential responsible party <br /> under CERCLA and or any other environmental statues and regulations. <br /> In closing,the Port would like to reiterate its liaison role as the coordinator and <br /> communicator between the Navy/CVRWQCB and the CP's construction project. In addition,the <br /> Port's role is further defined by assuring that the CP submits all the necessary plans, specifications, <br /> and any other necessary submissions prior to commencement of construction activities.
