Box 2089 <br /> Stockton, CA 95201-2089 <br /> ENVIRONMENTAL MANAGEMENT OF CLEAN PARCELS, NAVAL COMPUTER AND <br /> TELECOMMUNICATIONS STATION, SAN DIEGO DETACHMENT, STOCKTON <br /> The Board and Port of Stockton (parties) agree that future development activities on clean parcels <br /> transferred from the Navy to the Port of Stockton must not impact known or unknown contamination on <br /> adjacent properties. The parties also agree that the investigation and/or remediation of contamination <br /> found on clean parcels will prompt the Port of Stockton, and/or its tenants, to notify the Navy and the <br /> Board in order to evaluate the situation and take appropriate action. This letter summarizes and <br /> documents these agreements between the parties for the record. <br /> The Port of Stockton will take the following steps: <br /> • All documents which were generated to establish that the property is clean (i.e., baseline studies) and <br /> information on adjacent properties, whether clean or contaminated and a list of all pertinent local, <br /> state (e.g., environmental), and Federal regulations will be provided to the Construction Parties (CP). <br /> This information will assist the CP to develop construction plans which would be designed to avoid <br /> actions that could impact contamination on adjacent property(e.g., groundwater contaminant <br /> plumes). <br /> • A technical pre-design/construction meeting will be held with the CP. A list of required submittals <br /> (e.g., contingency plan) due to the Port will be provided to the CP. The Port will notify the Board <br /> one week prior to the meeting. <br /> • The CP will develop a decision tree, plans, specifications, and work plan (including a contingency <br /> plan) for addressing unforeseen contamination, which neither the Navy nor the CP's own pre- <br /> construction investigation may reveal. The contingency plan shall include the removal and disposal <br /> of solid waste and/or contaminated soil. The foregoing documents would then be subject to review <br /> and oversight by the Port and the Navy. The CP's plans will contain provisions for compliance with <br /> all local, state, and Federal requirements. <br /> California Environmental Protection:Agency <br /> �p�Recycled Paper <br />
