SAN J O A Q U I N Environmental Health Department <br /> ENDED <br /> 1/6/2020 <br /> Large Quantity Hazardous Waste Generator Inspection Report <br /> Facility Name: Facility Address: Date: <br /> PEP BOYS#562 1 1401 S CHEROKEE LN, LODI December 20, 2019 <br /> SUMMARY OF VIOLATIONS <br /> (CLASS I.CLASS II,or MINOR-Notice to Comply) <br /> Item# Remarks <br /> 403 CCR 66265.173 Failed to keep hazardous waste containers closed except when adding or removing hazardous <br /> waste. <br /> OBSERVATION:The following open hazardous waste storage containers were observed on-site: <br /> 1.A red 5-gallon container, about half filled with used oil,was observed with a hole in it's lid through which a drain <br /> tube ran from a metal oil filter crusher, located on the south side of the service bay area.The tube was not secured <br /> to the container, nor the lid, and there was enough space around the tube where it entered the lid hole to see the <br /> used oil in the container(see photos IMG 9873-7).The container was labeled as hazardous waste used oil and <br /> marked"drain weekly"in the space for the accumulation start date. <br /> 2.An open grey tote labeled"Returns Service"and located under a front register, contained a partially filled aerosol <br /> can of VHT Flame Proof Primer(IMG 9916, 9918-20).The aerosol can was missing it's actuator/nozzle and was <br /> labeled as"Extremely Flammable."It was unclear how long ago the aerosol can had been placed in the"Returns <br /> Service"tote. According to the facility's Hazardous Waste Training Guide, posted in the hazardous waste storage <br /> area next to the store's break room, items that are partially full and/or are missing the nozzle/cap are identified as <br /> waste, and flammable aerosols are identified as Hazardous Waste Aerosols, Flammables, and Combustibles(AF) <br /> (IMG 9948-59).At the time of inspection, hazardous waste storage area, located next to the store's break room, <br /> had an empty tote designated for Ignitable Flammable(FL) Hazardous Waste. <br /> REGULATION GUIDANCE:A container holding hazardous waste shall always be closed during transfer and <br /> storage,except when it is necessary to add or remove waste. <br /> CORRECTIVE ACTION: Immediately ensure all hazardous waste is placed in a closable container, close these <br /> containers. and ensure all hazardous waste containers are closed when not adding or removing waste. Provide a <br /> corrective action statement and supporting documentation to the San Joaquin County Environmental Health <br /> Department within 30 days. <br /> This is a Class II violation. <br /> 501 CCR 66262.34(f)Failed to completely label stationary hazardous waste tanks. <br /> OBSERVATION: The hazardous waste tank storing waste antifreeze and the hazardous waste tank storing oily <br /> water did not have complete labeling. Both tanks appeared to contain waste antifreeze and oily water, respectively, <br /> and were missing the accumulation start date(see photos 9888-97, 9900-5). <br /> REGULATION GUIDANCE: All hazardous waste tanks shall be marked with the words"Hazardous Waste"and <br /> the accumulation start date. <br /> CORRECTIVE ACTION: Label the hazardous waste tanks with the words"Hazardous Waste"and the <br /> accumulation start date.
