Ms. Donna Murphy - 3 - 11 April 2000 <br /> Notice of Noncompliance <br /> J.R. Simplot Company <br /> According to Order No. 97-229 Discharge Specifications B.10. Water Quality Protection Standards, <br /> the Discharger is required to develop background concentrations of each constituent of concern in <br /> each monitoring medium. For each monitoring event, the Discharger must determine whether there <br /> is a statistically significant evidence of a release from the waste management units, and whether the <br /> waste management units are in compliance with the Water Quality Protection Standard using <br /> procedures specified in Title 27. Constituents of concern and monitoring parameters, their <br /> concentration limits, the point(s) of compliance, and all water quality monitoring points are specified <br /> in Monitoring and Reporting Program (MRP) No. 97-229. Section B.1. Water Quality Protection <br /> Standard Report of the MRP states that the Discharger should have submitted a water quality <br /> protection standard report pursuant to Article 5 of Chapter 15 (now Title 27) and Order No. 94-189. <br /> See also Section D. Water Quality Protection Standard. <br /> Since a new constituent of concern has been identified and found in the waste management units, we <br /> request that perchlorate be analyzed as part of the quarterly and annual monitoring program for all <br /> groundwater monitoring wells. <br /> Please submit a copy of the Water Quality Protection Standard Report along with the SAP and <br /> QA/QCP reports required to be submitted by 1 June 2000. If this document has not been developed, <br /> please submit the.Water Quality Protection Standard Report by 1 July 2000. <br /> General Comments <br /> 1. Please bind and label all reports. <br /> 2. You are welcome to make an appointment to view other public documents (i.e., monitoring <br /> reports) as examples. We have previously provided J.R.
