Each of these findings includes subfindings that also must be made
by the Board. Both groups of findings are attached for Board con-
sideration and use (Attachment A) . Also attached are the findings
prepared by the applicant in support of required findings
(Attachment B) .
Alternative Use of Property. In submitting a petition for a
cancellation request, the landowner is required by State Law to
provide a proposal for a specified alternative use of the land.
The level of detail shown in this proposal must be determined by
the Board to be sufficient to permit them to make the required
findings. Attached is the applicant' s proposal for specified
alternative uses on the 86-acre parcel , including the 18 . 73 acre
portion under consideration (Attachment C) .
Included in the applicant ' s proposal is a list of those governmen-
tal agencies known by the applicant to have permit authority
related to the proposed alternative uses .
Environmental Considerations. An Initial Study, prepared for this
project on November 23 , 1987 , concluded that the proposed can-
cellation would not result in any significant environmental
impacts . Based on this Initial Study, a Negative Declaration has
been prepared.
Cancellation Value and Cancellation Fees. The County Assessor has
computed a cancellation value and cancellation fee for the subject
property based on the factored base year method, and a cancellation
value and cancellation fee based on the current market method. The
figures for each of the two methods are provided below:
1 . Factored base year method:
Cancellation Value: $64 , 272
Cancellation Fee: 8 , 034 ( i .e. , 12J% x 64272 )
2 . Current Market Method:
Cancellation Value: $532 ,500
Cancellation Fee: 66, 562 ( i. e. , 121% x 532 , 500 )
Prior to giving tentative approval to the cancellation of any
contract, the Board must determine and certify to the County
Auditor the amount of the cancellation fee that the landowner must
pay upon cancellation.
Conditions and Contingencies: Before the Board can execute a
[ final ] Certificate of Cancellation, the landowner must satisfy the
following conditions and contingencies:
1. Payment in full of the amount of the cancellation fee.
Unless the fee is paid by December 31, 1987, said fee shall
be recomputed as of the date of the notice from the land-
owner that he has satisfied all other conditions and con-
tingencies.
BOS LETTER PAGE 2
