Each of these findings includes subfindings that also must be made <br /> by the Board. Both groups of findings are attached for Board con- <br /> sideration and use (Attachment A) . Also attached are the findings <br /> prepared by the applicant in support of required findings <br /> (Attachment B) . <br /> Alternative Use of Property. In submitting a petition for a <br /> cancellation request, the landowner is required by State Law to <br /> provide a proposal for a specified alternative use of the land. <br /> The level of detail shown in this proposal must be determined by <br /> the Board to be sufficient to permit them to make the required <br /> findings. Attached is the applicant' s proposal for specified <br /> alternative uses on the 86-acre parcel , including the 18 . 73 acre <br /> portion under consideration (Attachment C) . <br /> Included in the applicant ' s proposal is a list of those governmen- <br /> tal agencies known by the applicant to have permit authority <br /> related to the proposed alternative uses . <br /> Environmental Considerations. An Initial Study, prepared for this <br /> project on November 23 , 1987 , concluded that the proposed can- <br /> cellation would not result in any significant environmental <br /> impacts . Based on this Initial Study, a Negative Declaration has <br /> been prepared. <br /> Cancellation Value and Cancellation Fees. The County Assessor has <br /> computed a cancellation value and cancellation fee for the subject <br /> property based on the factored base year method, and a cancellation <br /> value and cancellation fee based on the current market method. The <br /> figures for each of the two methods are provided below: <br /> 1 . Factored base year method: <br /> Cancellation Value: $64 , 272 <br /> Cancellation Fee: 8 , 034 ( i .e. , 12J% x 64272 ) <br /> 2 . Current Market Method: <br /> Cancellation Value: $532 ,500 <br /> Cancellation Fee: 66, 562 ( i. e. , 121% x 532 , 500 ) <br /> Prior to giving tentative approval to the cancellation of any <br /> contract, the Board must determine and certify to the County <br /> Auditor the amount of the cancellation fee that the landowner must <br /> pay upon cancellation. <br /> Conditions and Contingencies: Before the Board can execute a <br /> [ final ] Certificate of Cancellation, the landowner must satisfy the <br /> following conditions and contingencies: <br /> 1. Payment in full of the amount of the cancellation fee. <br /> Unless the fee is paid by December 31, 1987, said fee shall <br /> be recomputed as of the date of the notice from the land- <br /> owner that he has satisfied all other conditions and con- <br /> tingencies. <br /> BOS LETTER PAGE 2 <br />
