The Agreement specifically <br /> provides that the Tower Park Marina at Terminous will not under- <br /> take any development in excess of a 50 seat restaurant, an 82 <br /> unit travel trailer park and camp ground, 50 wet berths and 100 <br /> mobile homes until such time as a second phase of a water treat- <br /> ment plant consisting of the addition of mechanical equipment in <br /> the clarifier shell to perform the functions of primary mixing, <br /> floculation and clarification. <br /> Each of the undersigned expressly request that you not <br /> issue any use permits, building permits, or occupancy permits <br /> which would permit development in excess of the items specified <br /> above until such Phase II is completed. At the present time, <br /> the aforementioned restaurant, 82 unit travel trailer park and <br /> camp ground and 50 wet berths are in place and mobile homes are <br /> being developed. Accordingly, any new development other than <br /> mobile .homes or any mobile homes in excess of a total of 100 <br /> cannot be undertaken at the Tower Park Marina until the second <br /> stage facilities have been completed. You will be advised by <br /> the San Joaquin Local Health District or the Bureau of Sanitary <br /> Engineering of the Department of Public Health of the State of <br /> California that the necessary Stage II facilities have been com- <br /> pleted so that additional permits can be allowed. In this <br /> regard it is understood that developers and investors may apply <br /> for and obtain approval of a use permit for additional expansion <br /> if said use permit is expressly conditioned upon the completion <br /> of the necessary Stage II facilities. <br />
