I also need to be clear that while I understand you and AKF's frustration,you also need to understand our position as a very large company that is constantly being sued over ridiculous and innocent matters where Target has tried to do the right thing,but only gets its hand bitten in return. Also add in the fact that this store is located in arguably the most sue-happy state in the Union and you should understand our caution. I will do my best to get back to you within the next 24 hours. I work for a County government and 1 make compromises all the time. I am constantly asked to 'put the concern in perspective is it possible for Target to look at this isolated incident/situation from a point of view that it truly deserves? please consider the request. The thirty minutes to set up on the City sidewalk and the thirty minutes it should take to remove the plastic casing and fill the hole that is six inches on Target property may not happen if Target insurance requirements remain fixed as you mention. WHat could result if the well does not get removed by AKF is that TARGET will then become responsible for the well, afterall, it is ON Target property and Target will remain the owner of the well and be responsible for it. According to our County Ordinance, wells must serve their intented purpose. In addtion to 'monitoring' Monitoring wells, they must be monitored and reported or removed/destroyed under permit. Monitoring well(s) that are not monitored are subject to San Joaquin County Well Ordinance (abandonment) violations. These could include formal legals actions if an agreement can't be reached. Please do what you can to express to Target insurance/policy officials that allowing AKF 1/24/2011
