STOCKTON <br /> We are in receipt of the documents submitted on your behalf by Advanced GeoEnvironmental, Inc. (with <br /> their letter dated May 27,2003) in response to the Fund's final request for further documentation letter <br /> dated May 5, 2003. However, there are still issues that need to be resolved before we can determine your <br /> eligibility for placement on the Priority List. <br /> On page two (2) of your claim application, under List All USTs at Subject Site,you have only listed the <br /> four USTs that were removed in 1980 and excluded the four USTs "Reportedly filled with sand and <br /> abandoned in place in the late 1960's". Please note that claimant is not be eligible for any costs <br /> associated with the cleanup of any release which may have occurred from the USTs removed in 1980 <br /> because claimant never owned or operated these set of tanks (according to page three (3) of your claim <br /> application you acquired the site in November of 1982). <br /> You have provided a letter from San Joaquin County dated January 25, 1996, which says, "...there may <br /> have been an underground storage tank located on the property." It goes on to say "...results of <br /> groundwater sampling on July 31, 1995 and November 8, 1995 from a groundwater monitoring well, <br /> located in a City of Stockton easement directly adjacent to your property, suggests that there may have <br /> been a release from a former underground storage tank system... which may have contributed to the <br /> evidenced groundwater plume". This is not substantial evidence to show USTs exist/existed on your site, <br /> that there actually was a release from USTs on your site, or that the release occurred from the USTs that <br /> were "Reportedly filled with sand and abandoned in place in the late 1960's". <br /> In Advanced Geo Environmental, Inc.'s letter of May 27, 2003, they indicate that you are "requesting <br /> cleanup cost coverage for the in-place UST set, which operated fi-om 1932 until 1958 and are closed in <br /> place on the site". Additionally in their letter,they indicate "No cleanup order or cleanup up method has <br /> been determined at this time." <br /> The following information, is still needed to determine if your claim is eligible for placement onto the <br /> Priority List: <br /> 1. Revise page two of your claim application to include the set of abandoned in place USTs for <br /> which you are seeking reimbursement costs. <br /> 2. Provide substantial evidence to show when the abandoned in place set of USTs were abandoned. <br /> 3. Provide substantial evidence to show that the release occurred from the abandoned in place set of <br /> USTs. <br /> 4.
