Soil and groundwater sample results from the samples collected in
that location, as well as observations of stained soil and hydrocarbon odor during
collection of the samples confirmed contamination. The consultant also found
the location where the samples were collected in June 1996 and determined that
they were collected 10 to 15 feet east of where they should have been collected.
A copy of their letter explaining this is enclosed.
Please note that the letter provided to the responsible parties on May 27, 1997,
states that "with the provision that the information provided to this agency was
accurate and representative of site conditions, no further action related to the
underground tank release is required" (copNnclosed). Since the information
was not representative of site conditions because the sample collected in June
1996 was not collected from where the UST was really located, further
investigation is now required.
EHD provides notification to all responsible parties by Underground Storage
Tank Regulations definition (copy enclosed) that further site investigation is
required. It is up to the responsible parties to have the appropriately licensed
professional conduct the investigation.
I
