All information gathered during the study by Kleinfelder is considered confidential and will be released only upon written authorization from the client or as required by lava. California law requires a person to inform the state if a situation is encountered that can be considered an immediate endangerment to the public's health or welfare and/or to the environment. Therefore, the client will be contractually bound to make any said disclosures in lieu of Kleinfelder, its owners,principals, employees or subcontractors. CLIENT RESPONSIBILITIES AND ASSUMPTIONS This Proposal/Workplan and the attached cost estimate arc based on the following assumptions and responsibilities: • Ms. Duncan Keir will assist Kleinfelder in obtaining an acceptable access agreement for the site and owner authorization for the proposed sampling • Adequate workspace and access will be provided Kleinfelder will attempt to advance the probes and collect samples at the proposed locations. Lf the drilling equipment cannot be positioned, alternative drilling locations or sampling methods should be investigated. • Soil generated during the sampling will be placed in plastic bags and left onsita. The probes will be backfilled using grout or a bentonite-type slurry. • Soil and water generated during the drilling and sampling will be the responsibility of the client. Soil cuttings and decontamination rinsewater will be left on site. Sampling and analysis of the contained soil and water may be necessary prior to disposal. Disposal or remediation options for the soil and water can be assessed once analytical results have been received. Kleinfelder is prepared to assist the client and to remediate or dispose of stockpiled soil and water, if requested. • This Proposal/Workplan is based on the presumption that the client or owner will clearly mark utilities and will provide any and all available survey maps or other data to determine the location of existing structures, underground utilities and services. Ms. Duncan Keir should be aware that penetrating the site's surface is inherently risky. It is impossible to determine with certainty the precise location of all structures,which may be buried in the groupd. Kleinfelder's fee is not adequate to compensate for both the performance of the services and the assumption of risk of damage to such structures.
