California law <br /> requires a person to inform the state if a situation is encountered that can be considered an <br /> immediate endangerment to the public's health or welfare and/or to the environment. Therefore, <br /> the client will be contractually bound to make any said disclosures in lieu of Kleinfelder, its <br /> owners,principals, employees or subcontractors. <br /> CLIENT RESPONSIBILITIES AND ASSUMPTIONS <br /> This Proposal/Workplan and the attached cost estimate arc based on the following assumptions <br /> and responsibilities: <br /> • Ms. Duncan Keir will assist Kleinfelder in obtaining an acceptable access agreement for <br /> the site and owner authorization for the proposed sampling <br /> • Adequate workspace and access will be provided Kleinfelder will attempt to advance <br /> the probes and collect samples at the proposed locations. Lf the drilling equipment cannot <br /> be positioned, alternative drilling locations or sampling methods should be investigated. <br /> • Soil generated during the sampling will be placed in plastic bags and left onsita. The <br /> probes will be backfilled using grout or a bentonite-type slurry. <br /> • Soil and water generated during the drilling and sampling will be the responsibility of the <br /> client. Soil cuttings and decontamination rinsewater will be left on site. Sampling and <br /> analysis of the contained soil and water may be necessary prior to disposal. Disposal or <br /> remediation options for the soil and water can be assessed once analytical results have <br /> been received. Kleinfelder is prepared to assist the client and to remediate or dispose of <br /> stockpiled soil and water, if requested. <br /> • This Proposal/Workplan is based on the presumption that the client or owner will clearly <br /> mark utilities and will provide any and all available survey maps or other data to <br /> determine the location of existing structures, underground utilities and services. Ms. <br /> Duncan Keir should be aware that penetrating the site's surface is inherently risky. It is <br /> impossible to determine with certainty the precise location of all structures,which may be <br /> buried in the groupd.
