Advanced
GeoEnvironmental, Inc .
07 May 2009
AGE-NC Project No. 04-1220
Ms. Vicki McCartney
San Joaquin County Environmental Health Department
600 East Main Street w (J v
Stockton, CA 95201
MAY 1 1 2009
Subject: Quarterly Update - First Quarter 2009 ENVIRONMENT HEALIN
LOPEZ PROPERTY PERMIT/SERVICES
1601 Turnpike Road, Stockton, California
Dear Ms. McCartney:
On behalf of Ms. Mable Keir,Advanced GeoEnvironrnental, Inc. (AGE)has prepared this letter to
inform the San Joaquin ',County Environmental Health Department (EHD) no field work was
conducted at 1601 Turnpike Road, Stockton, California (site) during the first quarter 2009. A
quarterly ground water mnitoring event was not performed at the site due to the current status of
the State of California Underground Storage Tank Cleanup Fund(USTCF),which funds the site's
environmental cleanup.
As the EHD maybe aware, the USTCF has notified all claimants payment ofreimbursement requests
are delayed beyond "historical time periods." A Reimbursement Request for Ms. Keir for
approximately $55,000 was submitted to the USTCF in December 2008.It is unlikely Ms.Keir will
receive the reimbursement monies for 12 to 18 months.
Ms.Keir and AGE will continue to explore other financing options to augment the USTCF. One of
the most promising financial options is NatLust.Natlust's mission is to provide immediate liquidity
to Responsible Party's with approved fund claims where the particular state-administered trust fund
cannot reimburse claims in a timely manner. NatLust will help promote the state cleanup fund's
statutory goals, which typically include meeting EPA's financial responsibility regulations, as well
as promoting a cleaner environment and improved public health through a timely cleanup.Recently,
NatLust met with the California State Water Resources Control Board to develop a process for
NatLust to operate in Cal ifornia. From our communications with Mr.Lindsay Trittipoe (President
of NatLust), it appears N itLust will be able to begin operating in California by 0 July 2009. For
more information, please see the NatLust website http://www.natiust.org/.
Additionally,Ms.Keir an d AGE are currently preparing an additional letter to address the directives
made by EHD in a letter dated 02 April 2009. Directives include modification of the ground water
monitoring program, preparation of a work plan for the installation of additional HU2 wells east to
837 Shaw Road,Stockton, California 95215
Telephone (209)467-1006 Fax (209)467-1118
