(AGE)has prepared this letter to <br /> inform the San Joaquin ',County Environmental Health Department (EHD) no field work was <br /> conducted at 1601 Turnpike Road, Stockton, California (site) during the first quarter 2009. A <br /> quarterly ground water mnitoring event was not performed at the site due to the current status of <br /> the State of California Underground Storage Tank Cleanup Fund(USTCF),which funds the site's <br /> environmental cleanup. <br /> As the EHD maybe aware,the USTCF has notified all claimants payment ofreimbursement requests <br /> are delayed beyond "historical time periods." A Reimbursement Request for Ms. Keir for <br /> approximately $55,000 was submitted to the USTCF in December 2008.It is unlikely Ms.Keir will <br /> receive the reimbursement monies for 12 to 18 months. <br /> Ms.Keir and AGE will continue to explore other financing options to augment the USTCF. One of <br /> the most promising financial options is NatLust.Natlust's mission is to provide immediate liquidity <br /> to Responsible Party's with approved fund claims where the particular state-administered trust fund <br /> cannot reimburse claims in a timely manner. NatLust will help promote the state cleanup fund's <br /> statutory goals,which typically include meeting EPA's financial responsibility regulations, as well <br /> as promoting a cleaner environment and improved public health through a timely cleanup.Recently, <br /> NatLust met with the California State Water Resources Control Board to develop a process for <br /> NatLust to operate in Cal ifornia. From our communications with Mr.Lindsay Trittipoe (President <br /> of NatLust), it appears N itLust will be able to begin operating in California by 0 July 2009. For <br /> more information,please see the NatLust website http://www.natiust.org/. <br /> Additionally,Ms.Keir an d AGE are currently preparing an additional letter to address the directives <br /> made by EHD in a letter dated 02 April 2009.
