The Order also <br /> includes an interim limitation for temperature applied at French Camp Slough. <br /> The Discharger has shown the ability to comply with the interim limitations required in <br /> Receiving Water Limitations E.1 and E.8. However, the Discharger is unable to comply with the <br /> final limitations. Since the beneficial uses of North Littlejohns Creek are not specified in the <br /> Basin Plan, the Discharger has requested a site-specific basin plan amendment to determine the <br /> beneficial uses of North Littlejohns Creek. This request was based on Draft Orders addressing <br /> petitions challenging NPDES permits for the Cities of Vacaville and Turlock that are under <br /> consideration by the State Water Resources Control Board (State Board). This Resolution <br /> amends Order 5-01-119 to provide an extension of the compliance schedules one year for <br /> Receiving Water Limitations E.1 and E.8. The extension is needed to evaluate the applicability <br /> of the pending Orders by the State Board,with respect to the Stockton Cogeneration Facility. <br /> The new compliance date will be 1 November 2003. <br /> Chlorine Residual—The Discharger also requested an extension of the effluent chlorine residual <br /> limitation required in Effluent Limitation B.1,which becomes effective 1 November 2002. The <br /> Discharger has demonstrated the ability to meet the new limitation,but requested an extension <br /> due to uncertainty that arose from recent negative chronic toxicity test results. Since chlorine is <br /> acutely toxic to aquatic life, and the Discharger is capable of meeting the new chlorine residual <br /> limitation, Regional Board staff do not recommend extending the compliance schedule. <br /> Recommendation: <br /> Adopt the proposed resolution amending Order No. 5-01-119. <br />
