Messrs. Hall and Musco - 2 - 28 January 2003
Because the WDRs do not allow discharge of wastewater constituents, bypass of stormwater with
residual concentrations of wastewater constituents would constitute a violation of the WDRs, Cleanup
and Abatement Order No. R5-2002-0149, and Time Schedule Order(TSO)No. R5-2002-0014-R01.
Violations of the orders may result in civil liability as described in Water Code Section 13385 and the
TSO.
In addition, it should be recognized that the stormwater bypass monitoring is in addition to stonnwater
monitoring required by the WDRs and Monitoring and Reporting Program No. R5-2002-0148. As
required by the Standard Provisions, all monitoring performed in addition to that required by the MRP
must be submitted in the next regularly scheduled monitoring event.
By 28 February 2003,please submit a complete report that includes a discussion of the above items.
Until the report is approved by the Executive Officer,Musco must continue to collect all its stormwater.
If you have any questions regarding this report review, please telephone me at (916) 255-3116.
TIMOTHY R.
