The current flow limit is contained in Order
No. R5-2002-0014, a California Water Code Section 13308 Time Schedule Order adopted by
the Regional Board on 25 January 2002. Musco is requesting an increase in the maximum
daily flow from 750,000 gallons per day (gpd) to 950,000 gpd and an increase in the average
weekly flow from 600,000 gpd to 820,000 gpd. Musco also wishes to begin the increased
flows effective 8 April 2002.
I am unable to respond definitively to your request at this time. The water balance attached to
your facsimile is illegible. Once staff receives a legible version of the water balance, they will
need time to review the data. If the information appears credible, then a site inspection will be
scheduled. If the inspection shows that Musco has made the described improvements and
appears able to handle the increased flows without violating any other provisions of the Time
Schedule Order, then the Regional Board will be asked to consider amending the Order. The
soonest this action could be taken is the 6-7 June 2002 Regional Board meeting.
Notwithstanding the above, the Board recognizes that Musco must take the actions it deems
necessary to remain in business. If all the improvements described in the 6 April 2002 letter
have been completed, if the water balance is accurate and shows that the crops will take up the
additional wastewater, and if the wastewater will be applied in a manner that prevents
additional types of violations, then the increase in flow may be acceptable to the Regional
Board.
Califorliia Environmental Protection Agency
cd Recycled Paper
The energy challenge facing California is real.
