Mr. Ben Hall - 2 - 28 April 2004
Musco Family Olive Company
These reports are necessary to (1) characterize the quality of surface waters emerging upstream of the
reservoir and water discharging from the dam's blanket drain, (2) assess the extent to which impounded
wastewater is contributing to the blanket drain discharge, and (3) and characterize groundwater quality
for decomposition byproducts. Musco conducts the activities and discharges the waste that created the
necessity. As the information is important to eventually reconciling Musco's violations of the California
Water Code, we expect that Musco will cooperatively provide the reports. However, as with any formal
request for monitoring, failure or refusal to provide the data may result in assessment of administrative
civil liability pursuant to California Water Code Section 13268.
If you will be unable to comply with the due date set in this document or have questions regarding the
report due, please contact Amy Simpson, project engineer, at (559) 445-6187 promptly to explain the
situation.
If you have additional technical information pertaining to Task 16 that would warrant a re-evaluation of
the situation,please provide it forthwith.
ATHINKOS
Ex utive Officer
Enclosures: Staff memorandum dated 28 April 2004 from Jo Anne Kipps to Bert Van Voris
List of monitored constituents
cc w/encl: Catherine George, Office of Chief Counsel, State Water Resources Control Board,
Sacramento
Ms. Teresa Geimer, California Department of Water Resources, Sacramento
Ms. Charyce Taylor, California Department of Water Resources, Fresno
Mr. Mike Huggins, San Joaquin County Environmental Health Department, Stocktb
Mr. David Irey, Esq., San Joaquin County District Attorney, Stockton
Mr. Michael Campos, Esq., Stoel Rives LLP, Sacramento
Mr. Bill Jennings, DeltaKeeper, 3536 Rainer Avenue, Stockton, CA, 95204
Mr. Paul Harpainter, Tracy
V:\Municipal\Pmjects\Outgoing.2004\enforcement\NOVs\jlk MuscoSeepage.NOV.doc
N15/B/MUSCO FAMILY OLIVE COMPANY/W WT&LAND DISPOSAL FACILITY/SB392059002
