R5-2002-0148 AND <br /> WATER CODE SECTION 13267 REQUEST TO SUBMIT MONITORING DATA,MUSCO <br /> FAMILY OLIVE COMPANY, SAN JOAQUIN COUNTY <br /> Musco Family Olive Company and the Studley Company(hereafter Musco) are in violation of Waste <br /> Discharge Requirements Order No. R5-2002-0148, Discharge Prohibition A.1, for the indirect discharge <br /> of waste to a surface water drainage course. Further, Musco is in violation of Task 16 of Revised Time <br /> Schedule Order No. R5-2002-0014-R01 (TSO). The TSO describes this task as follows: <br /> By 15 August 2002, the Discharger shall submit a report showing that the pond and tailwater <br /> system have been fully constructed and are operational. The report shall also describe the pond <br /> construction details and show that a liner, adequate to prevent the stored wastewater from <br /> impacting the groundwater, has been installed. The penalty shall be$5,000 for each day after <br /> 15 August 2002 in which the pond and/or tailwater system are not operational. <br /> The violations were determined as described in the enclosed Regional Board staff memorandum. <br /> Pursuant to Section 13267 of the California Water Code,you are required to submit the following: <br /> By 28 May 2004, a technical report describing a work plan and implementation schedule for <br /> installing the necessary piping and appurtenances that will effectively and reliably preclude <br /> the discharge of seepage from the dam's blanket drain to the surface water drainage course. <br /> The schedule must complete the installation within 30 days of technical report approval. <br /> Effectively immediately, analyze the seepage during the next year twice monthly in <br /> nonconsecutive weeks for constituents and parameters identified in the enclosed list. If water <br /> is emerging from the spring upgradient of the reservoir, sample this water the same time you <br /> sample the seepage. If spring flow is not present indicate this on the monitoring form. Also, <br /> effective immediately, include arsenic, iron, and manganese in the list of General Minerals <br /> monitored in groundwater. Submit the monitoring results by the 1st day of the second <br /> month following sampling with your monthly self-monitoring report or, if groundwater data, <br /> in quarterly groundwater monitoring results report.
