ATTACHMENT A <br /> 7.0 MITIGATION MONITORING PROGRAM <br /> INTRODUCTION <br /> This Mitigation Monitoring Program has been prepared in compliance with Section 21081.6 of the Public <br /> Resources Code. Section 21081.6 states that"when making the findings required by subdivision (a)of Section <br /> 21081(1)" or "when adopting a negative declaration pursuant to paragraph (2) of subdivision (c) of Section <br /> 21080, the public agency shall adopt a reporting or monitoring program for the changes to the project which <br /> it has adopted or made a condition or project approval in order to mitigate or avoid significant effects on the <br /> environment. The reporting or monitoring shall be designed to ensure compliance during project <br /> implementation." Monitoring is not required for impacts that are not significant. Therefore, this monitoring <br /> program only addresses significant impacts associated with the project, and identified in the EIR. <br /> The recommended mitigation measures will require monitoring by San Joaquin County Community <br /> Development Department and a number of other agencies (Table 7.1). Under the provisions of Section <br /> 21081.6, San Joaquin County, as lead agency, can assess the applicant a fee for the monitoring program. <br /> Alternatively, the applicant can retain independent consultants to complete a number of the monitoring <br /> measures, as appropriate. The components of the monitoring program include the following (Table 7.1): <br /> ■ Summary of significant impacts identified in the Environmental Impact Report; <br /> ■ Mitigation measures recommended for each significant impact; <br /> ■ Monitoring requirements for each mitigation measure; <br /> ■ Person/agency responsible for the mitigation measure monitoring; <br /> ■ Timing or frequency of monitoring. <br /> Reporting of the monitoring activities will be required to verify that monitoring has taken place. To facilitate <br /> an efficient oversight program, this DEIR recommends that the San Joaquin County Community <br /> Development Department maintain all reporting form files, even though additional agencies may also have <br /> their own records. The applicant would be responsible for a number of the recommended mitigation <br /> measures. However, only that person or agency responsible for ensuring compliance with the mitigation <br /> measures is identified in Table 7.1.
