The owner or operator shall operate and maintain the facility in accordance with the Operation Plan. 3. In the event of any conflict between this permit and the Operation Plan referenced herein, the provisions of the permit shall be controlling. 4. The Operation Plan shall be maintained at the facility at all times until closure is completed. G. General Responsibilities of Operator 1. Compliance a. The owner or operator shall comply with all conditions of this permit, except to the extent and for the duration such noncompliance is authorized by an emergency permit or approved by the Department. Any permit noncompliance constitutes grounds for enforcement action, permit termination, revocation and reissuance, modification, or for denial of a permit renewal application. b. The owner or operator shall comply with all laws, regulations, permits, zoning conditions, and all other requirements established by federal, state, and local agencies. 2. Reapplication If the owner or operator wishes to continue an activity regulated by this permit after the expiration date of this permit, the owner or operator must submit a completed application for a new permit at least 180 days before this permit expires. 3. Permit Expiration This permit and all conditions therein will remain in effect beyond the permit expiration or termination date if the owner or operator has submitted a timely, completed application and, through no fault of the owner or operator, the Department has not issued a new permit. 4. Transfer of Permit This permit may be transferred to a new owner or operator only if it is modified or revoked and reissued pursuant to Sections 66382 (b) (2) or 66385 (d) , Title 22, CAC.
