A dispute exists regarding the Enforcement Order <br /> 15 issued by the Department on December 16, 1994. (Attached as <br /> 16 Exhibit 1. ) <br /> 17 2. The parties wish to avoid the expense of further <br /> 18 litigation and to ensure prompt action to achieve the Schedule <br /> 19 for Compliance below. <br /> 20 3. Jurisdiction exists pursuant to Health and Safety <br /> 21 Code (HSC) section 25187. <br /> 22 4. Respondent waives any right to a hearing concerning <br /> 23 the violations alleged in the Enforcement Order. <br /> 24 5.
