Code Regs. , Section 66265.191(a) in that <br /> Respondent failed to determine whether a tank was leaking or <br /> unfit, and failed to keep a written integrity assessment <br /> certified by registered professional engineer for tanks without <br /> secondary containment, to wit: As of April 19, 1993, the <br /> Respondent had not integrity tested the waste solvent tank <br /> located at Building 707. <br /> 2.2 Respondent violated Title 22, Cal. Code Regs. , Section <br /> 66265.31: On or about April 19, 1993, Respondent violated Title <br /> 22, Cal. Code Regs. , Section 66265.31 in that Respondent did not <br /> maintain and operate the facility to minimize the possibility of <br /> a fire, explosion, or any unplanned release of hazardous waste or <br /> hazardous waste constituents to air, soil, or surface water, to <br /> wit: An underground tank used to store waste solvent located at <br /> Building 707 was not adequately monitored to detect releases of <br /> hazardous waste. As of the April 19, 1993, inspection, the tank <br /> had never been integrity tested per the facility operations plan. <br /> 2 <br />
