waste obtained using test method 1311 in "Test Methods of Evaluating Solid Waste, Physical/Chemical <br />Methods," "USEPA Publication SW -846, as referenced in section 66260.11 of this division, depending on <br />whether the treatment standard for the waste is expressed as a total concentration or concentration of <br />hazardous constituent in the waste's extract. Alternatively, the generator may send the waste directly to a <br />hazardous waste treatment facility, where the hazardous waste treatment facility shall comply with all <br />requirements of section 66264.13 of this division and paragraph (b) of this section. In addition, some <br />hazardous wastes shall be treated by particular treatment methods before they can be land disposed and <br />some soils are contaminated by such hazardous wastes. These treatment standards are also found in section <br />66268.40, and are described in detail in section 66268.42, Table 1. These wastes, and soils contaminated <br />with such wastes, do not need to be tested (however, if they are in a waste mixture, other wastes with <br />concentration level treatment standards would have to be tested). If a generator determines they are <br />managing a waste or soil contaminated with a waste, that displays a hazardous characteristic of ignitability, <br />corrosivity, reactivity, or toxicity, they shall comply with the special requirements of section 66268.9 of this <br />chapter in addition to any applicable requirements in this section. <br />Immediately, provide a LDR for all applicable hazardous waste disposal. <br />Violation 202, HSC 25189.5(a). Disposed or caused disposal of hazardous waste at an unauthorized <br />point. <br />Facility owner stated he used waste oil to kill weeds around the facility property. <br />(a) The disposal of any hazardous waste, or the causing thereof, is prohibited when the disposal is at a <br />facility which does not have a permit from the department issued pursuant to this chapter, or at any point <br />which is not authorized according to this chapter. <br />Immediately, cease illegal disposal of hazardous waste. <br />Violation 203, HSC 25189.50. Transported or caused transportation of hazardous waste to an <br />unauthorized point. <br />Facility owner stated hazardous waste was transported from his facility at 2000 Sanguinetti Lane in Stockton <br />to this location by his employees. Facility owner also stated hazardous waste is routinely moved from 1000 E. <br />Channel to 1015 E. Channel Street in Stockton. <br />(c) Any person who knowingly transports or causes the transportation of hazardous waste, or who reasonably <br />should have known that he or she was causing the transportation of any hazardous waste, to a facility which <br />does not have a permit from the department issued pursuant to this chapter, or at any point which is not <br />authorized according to this chapter, shall, upon conviction, be punished by imprisonment in a county jail for <br />not more than one year or by imprisonment pursuant to subdivision (h) of Section 1170 of the Penal Code. <br />Immediately, stop transporting or causing the transport of hazardous waste to an unauthorized <br />point, <br />Violation 301, CCR 66265.31. Facility not maintained to minimize the release of a hazardous waste. <br />This is a repeat violation. <br />Multiple locations throughout the facility revealed hazardous waste allowed to remain on the ground without <br />being cleaned up, hazardous waste stored in corroded or not sound or compatible containers, corroded <br />beams holding totes or tanks of hazardous materials off the ground, and leaking containers of hazardous <br />waste.
