CCR 66265.192: The facility did not have a tank assessment document for the used oil tank. <br />A tank assessment is site specific and is stamped by a Professional Engineer. Submit a <br />statement by April 29, 2011 explaining how the facility will comply with this regulation. <br />Send a copy of the tank assessment to the Environmental Health Department (EHD) when the <br />assessment is complete. <br />On March 19, 2009, BSRO commissioned an Above -Ground Storage Tank Assessment for <br />the Facility's used oil tank. The assessment, which was conducted by Apex Companies, <br />LLC, includes certification by a Professional Engineer (PE) in conformance with 22 C.C.R. <br />§ 66265.192. BSRO has instructed the Facility to keep the assessment on-site and readily <br />accessible. A copy of the Above -Ground Storage Tank Assessment is attached as Exhibit G. <br />6. CCR 66265.51: The facility does not have a hazardous waste contingency plan. Generate a <br />plan, keep a copy at the facility and send a copy to the EHD by April 29, 2011. <br />A copy of the Facility's contingency plan is attached hereto as Exhibit H. A copy of the <br />attached plan is also maintained on-site at the Facility. <br />BSRO appreciates the opportunity to provide this information to you. We take our <br />compliance obligations very seriously and have immediately addressed each of the items raised <br />in the Notice to Comply. BSRO believes that the Facility is currently in compliance and that no <br />further action is warranted under these circumstances.
