AIL <br /> WA TE DISCHARGE REQUIREMENT <br /> MC CORMICK AND BAXTER CREOSOTING COMPANY <br /> SAN JOAQUIN COUNTY <br /> 7. Effluent limitations, national standards of performance, and toxic and <br /> pretreatment effluent standards established pursuant to Sections <br /> 301, 302, 303(d) , 304, and 307 of the Federal Water Pollution Control Act <br /> and amendments thereto are applicable to the discharge. <br /> 8. The discharge from McCormick and Baxter Creosoting Company is presently <br /> governed by waste discharge requirements adopted by the Board on 23 August <br /> 1974 in Order No. 74-407. <br /> 9. The action to adopt an NPDES permit is exempt from the provisions of the <br /> California Environmental Quality Act (Public Resources Code Section <br /> 21000, et seq.) in accordance with Section 13389 of the California Water <br /> Code. <br /> 10. The Board has notified the discharger and interested agencies and persons <br /> of its intent to prescribe revised waste discharge requirements for this <br /> discharge and has provided them with an opportunity for a public hearing <br /> and an opportunity to submit their written views and recommendations. <br /> 11. The Board in a public meeting heard and considered all comments pertaining <br /> to the discharge. <br /> 12. This Order shall serve as a National Pollutant Discharge Elimination System <br /> permit pursuant to Section 402 of the Federal Water Pollution Control Act, or <br /> amendments thereto, and shall take effect ten days from the date of hearing <br /> provided EPA has no objections. <br /> IT IS HEREBY ORDERED, McCormick and Baxter Creosoting Company, in order to meet <br /> the provisions contained in Division 7 of the California Water Code and regulations <br /> adopted thereunder and the provisions of the Federal Water Pollution Control Act <br /> and regulations and guidelines adopted thereunder, shall comply with the following: <br /> A. Effluent Limitations; Discharge 001: <br /> 1. The discharge shall not contain constituents in excess of the following <br /> limits: <br /> 30-day Daily <br /> Constituents Units Average Maximum <br /> Arsenic mg/l 0.05 0.1 <br /> lbs/day 0.1 0.2 <br /> Copper mg/1 0.05 0.1 <br /> lbs/day 0.1 0.2 <br /> Phenols mg/l - - 0.01 <br /> lbs/day _ - 0.02 <br /> Oil and Grease mg/l - - 10. <br /> lbs/day - 21. <br /> - 2 <br /> Amended FOM/gs 5/30/80 <br />
