Based on the provided analytical report the following <br />metals were detected at levels which require further analysis (for RCRA waste determination): antimony, arsenic, <br />cadmium, copper, lead, nickel, selenium, and thallium. Any person who generates a waste shall determine if the <br />waste is a hazardous waste. Immediately make a full hazardous waste determination for all onsite metal fines waste <br />streams, and manage them according to Title 22 hazardous waste regulations. Particles 100 microns or smaller must <br />be handled as hazardous waste if the metal is determined to be a hazardous waste. Submit a statement and <br />supporting documentation explaining how this waste is being managed. <br />This is a Class II violation. <br />107 CCR 66265.52 Contingency plan is incomplete. <br />The facility's contingency plan is incomplete, the emergency coordinator information is lacking. The contingency plan <br />must include: <br />1. Description of actions facility personnel will take in response to fires, explosions, or any sudden or non -sudden <br />release of hazardous waste to air, soil or surface water at the facility; <br />2. Description of arrangements made with local police departments, fire departments, hospitals, contractors and <br />State and local emergency response teams to coordinate emergency services; <br />3. List of names, addresses, and phone numbers (office/home/cell) of all persons qualified to act as emergency <br />coordinator. Where more than one person is listed, one shall be named as the primary emergency coordinator and all <br />others in order in which they will assume responsibilities; <br />4. List all emergency equipment, which includes location, physical description, and brief outline of its capabilities; <br />5. Evacuation routes for facility personnel where there is a possibility of evacuation; <br />6. Current telephone number for State Office of Emergency Services. <br />If the facility has a Spill Prevention, Control and Countermeasures plan, or some other emergency or contingency <br />plan, the owner or operator need only amend that plan to incorporate hazardous waste management provisions that <br />are sufficient to comply with the requirements of this chapter. Immediately prepare or amend an existing plan to fulfill <br />the requirements of this chapter.
