The parties have entered into this Amendment in accordance with legal requirements imposed <br /> on ARCO and Franchisee concerning operation of the underground storage tanks at the above-referenced <br /> location. <br /> 2. ARCO has provided Franchisee a copy of: <br /> (a) California Health and Safety Code Section 25299 or an approved summary concerning civil <br /> and criminal penaltiewfor violating terms of any permit to operate these underground storage <br /> tanks and relevant statutory and regulatory requirements; <br /> (b) the following listed documents, a copy of which <br /> '�is attached and initialed by Franchisee: <br /> ® IJU% 01 <br /> 9 +3 <br /> T <br /> 3. Where ARCO has provided Franchisee with a copy of the permit to operate the underground <br /> storage tanks, Franchisee has read and understood its responsibilities as operator under the permit <br /> and agrees to comply with each of the provisions of the permit. Irrespective of whether Franchisee <br /> has received and reviewed a copy of the underground storage tank operating permit, Franchisee hereby <br /> expressly agrees to do the following: <br /> (a) monitor the underground tanks as required by law; <br /> (b) maintain all required records and make such records available to the federal, stag <br /> and local government agencies and to ARCO at all reasonable times; <br /> (c) follow all reporting procedures as required by law; <br /> (d) mail, when submitted, to ARCO, at the address specified in paragraph 1 of the PMPA <br /> Franchise Agree mentfDealer/Prem ises Lease, a copy of all reports submitted to government <br /> agencies; <br /> CA <br /> (1/92) 1 of 2 <br /> PARSBV <br />
