c <br />In <br />This requirement must be met in order to continue use of the <br />underground storage tank. The owner of the underground storage <br />system will be required to make upgrades in order to meet 1998 <br />upgrade requirments. This Department requires that all sites that <br />plan to use single wall fiberglass tanks, lined tanks or a lining <br />process to meet 1998 upgrade requirements have a site assessment <br />conducted. The site assessment must be conducted in accordance <br />with PHS-EHD Policy number 96-004(copy provided). If <br />contamination is encountered during the site assessment it will <br />be considered an unauthorized release and Health and Safety Code <br />Section 25296 (c) may apply. Section 25296 allows PHS-EHD to <br />require the installation of a continuous monitored monitoring <br />well. The requirement for a continuously monitored monitoring <br />well may be waived if the tank system is equiped with a <br />continuous monitoring system that meets the current LG113 <br />standards. The tanks must be equiped with spill and overfill <br />protection in accordance with Title 23 CCR Section 2665(provided <br />below) . <br />523-2665. Spill and Overfill Prevention Equipment Upgrade Requirements. <br />By December 22, 1998, all underground storage tank systems shall be retrofitted with an <br />overfill prevention system and a spill container which meet the requirements of section <br />2635(b). The local agency may waive the requirements for overfill prevention equipment if <br />the conditions specified in section 2635(b)(3) are met. <br />523-2635. Installation and Testing Requirements for All New Underground Storage Tanks. <br />(b) All underground storage tanks shall be equipped with a spill container and an <br />overfill prevention system as follows: <br />(1) The spill container shall collect any hazardous substances spilled during product <br />delivery operations to prevent the hazardous substance from entering the subsurface <br />environment. The spill container shall meet the following requirements: <br />(A) If it is made of metal, the exterior wall shall be protected from galvanic <br />corrosion. <br />(B) It shall have a minimum capacity of five gallons (19 liters). <br />(C) It shall have a drain valve which allows drainage of the collected spill into <br />the primary container or provide a means to keep the spill container empty. <br />(2) The overfill prevention system shall not allow for manual override and shall meet one <br />of the following requirements: <br />(A) Alert the transfer operator when the tank is 90 percent full by restricting <br />the flow into the tank or triggering an audible and visual alarm; or <br />(B) Restrict delivery of flow to the tank at least 30 minutes before the tank <br />overfills, provided the restriction occurs when the tank is filled to no more than <br />95 percent of capacity; and activate an audible alarm at least five minutes before <br />the tank overfills; or <br />(C) Provide positive shut-off of flow to the tank when the tank is filled to no <br />more than 95 percent of capacity; or, <br />(D) Provide positive shut-off of flow to the tank so that none of the fittings <br />located on the top of the tank are exposed to product due to overfilling. <br />(3) The local agency may waive the requirement for overfill prevention equipment where the <br />tank inlet exists in an observable area, the spill container is adequate to collect any <br />overfill, and the tank system is filled by transfers of no more than 25 gallons at one <br />time. <br />The piping system will require upgrading if it is constructed of <br />single wall steel and was not cathodically protected from the <br />point of its original installation. The piping must be upgraded <br />to meet Title 23 CCR Section 2666 (provided below). <br />(a) By December 22, 1998, all underground piping containing hazardous substances other <br />than motor vehicle fuel shall be retrofitted with secondary containment meeting the <br />requirements of section 2636. <br />
