Box 181 <br />Livermore, CA 94551 <br />EPA Identification Number: CA2 890 090 002 <br />Dear Mr. Scott; <br />On July 28, 2009, a hazardous waste compliance inspection was conducted by <br />representatives of the United States Environmental Protection Agency ("EPA"), accompanied by <br />a representative of California's Certified Unified Program Agency (COPA), at Lawrence <br />Livermore National Laboratory (LLNL), Site 300, located in Livermore, California, with EPA <br />Identification Number CA2 890 090 002. During the course of this investigation, information was <br />gathered in accordance with Section 3007(a) of the Resource Conservation and Recovery Act <br />("RCRA"), as amended (42 U.S.C. § 6927(a)). <br />A copy of the inspection report is enclosed for your information and response. The report <br />describes conditions at the facility at the time of the investigation, and identifies areas of <br />noncompliance with RCRA regulations and potential violations of the State of California <br />authorized program under RCRA Subtitle C and potential non-RCRA state violations. Any <br />omissions in the report shall not be construed as a determination of compliance with any other <br />applicable regulation. <br />Site 300's responses during the inspection adequately addressed the observed potential <br />violations of the federally authorized RCRA program noted during the inspection and documents <br />Site 300's return to compliance with the federally authorized regulations. <br />By copy of this letter, the EPA is providing the State of California with notice that the EPA <br />will not take enforcement actions. The State of California may notify the EPA of its intent to <br />assume or decline responsibility to take such action to resolve the referenced RCRA Subtitle C <br />violations. <br />
