In this regard, <br /> I am informed that the noise coming from the <br /> pump located in or over that well is a constant <br /> source of irritation to the residents in the <br /> immediate area; <br /> 3 . The issuance of an Environmental Assessment <br /> Report with respect to my clients ' three <br /> parcels and at no cost to them. <br /> In addition to the foregoing items, any written agreement <br /> between the parties would also have to provide for the Rochas to <br /> be reimbursed for their attorney's fees in connection with this <br /> matter. <br /> My clients are cognizant of the fact that Southland is <br /> obligated by law to take all action which is necessary to determine <br /> the extent of the contamination resulting from the underground <br /> gasoline storage tanks on the 7- Eleven site and to implement <br /> appropriate remedial measures. As indicated above, they are <br /> willing to enter into a written agreement which would authorize <br /> Southland to maintain the two monitoring wells on their property <br /> as long as such agreement contains the terms and conditions <br /> referred to above. If the proposed agreement has not been executed <br /> by both parties within 30 days after the date of this letter, you <br /> are hereby instructed to immediately remove at that time the <br /> monitoring wells and any related facilities and equipment located <br /> on the Rochals property and to restore the property to its prior <br /> condition. <br /> I look forward to hearing from you as soon as possible. <br /> Very truly yours, <br /> KIM A.
