Sox 404 <br /> Pleasanton, CA 94566 <br /> Re: Agresmsnt between Robert and Susan Rocha and <br /> The Southland Corporation dated Marob 31, 1987 <br /> (90Agreement1g) <br /> Dear Mr. Lubcke: <br /> I am writing to you in Connection with the above-referenced <br /> Agreement pursuant to which The Southland Corporation ("Southland") <br /> was allowed to install, operate and maintain two groundwater <br /> monitoring wells on one or more parcels owned by my clients, Robert <br /> and Susan Rocha. Under paragraph 6A of the Agreement, the <br /> Agreement expired in December of 1989. However, it is my <br /> understanding that the monitoring wells remain in place and are <br /> being operated by Southland notwithstanding the fact that Southland <br /> has no legal right at this time to use my clients, property for <br /> such purposes. <br /> As you know, the purpose of the monitoring wells is to <br /> determine whether any underground contamination from the nearby 7- <br /> Eleven site has entered the groundwater under and/or contaminated <br /> the wells located on any of the adjacent properties. Although the <br /> Rochas are very concerned with this situation because of its <br /> potential impact on the use and market value of their various <br /> parcels, they will = allow the monitoring wells to continue to <br /> be maintained and operated on their property without a written <br /> agreement that is mutually acceptable to both parties. Such an <br /> agreement would have to provide for the following: <br /> 1. Reasonable compensation to the Rochas for the <br /> use of their property; <br />
