Item No. 1 <br /> ( 2 ) The fee for the construction of the Master Planned <br /> Water Facilities shall be $2 , 800 per lot and will be <br /> adjusted annually following the execution of the <br /> Agreement , in accordance with the Engineering News <br /> Record Cost Index. <br /> (3) Funds collected for the Master Planned Water <br /> Facilities shall be placed in an interest-bearing <br /> trust account with the County of San Joaquin. <br /> (4) Master Planned Water Facilities fees shall be paid for <br /> at the time of issuance of a Building Permit . <br /> (5 ) The Agreement shall provide that the funds will be <br /> collected for a maximum of 15 years from the date the <br /> Agreement is executed. If the public water system is <br /> not constructed within 15 years from the date of <br /> Agreement execution, the funds, including interest , <br /> will be proportionately returned to the owner of the <br /> property at that time. <br /> (6) In the event that the funds collected are insufficient <br /> to construct the Master Planned Water Facilities, the <br /> owner of the property will at that time be obligated <br /> to pay his proportionate share of the difference. In <br /> the event surplus funds are available after construc- <br /> tion of the Master Planned Water Facilities, the funds <br /> with interest shall be returned proportionately to the <br /> owners of the proerty at that time or , at the County' s <br /> option, placed in the operating account of the County <br /> Service Area for the operation and maintenance of the <br /> system. <br /> m. The developer shall install "dry" water lines within the <br /> limits of the subdivision which will conform to the pro- <br /> posed Master Plan. The dry potable water supply line <br /> system shall consist of the distribution lines, service <br /> connections to the property line, and stub-outs for future <br /> hydrants and all appurtenances. At the time a public <br /> water system is available, all lots will be required to <br /> connect to that system in accordance with Ordinance Code <br /> Section 5-3108 . <br /> n. The developer shall initiate the formation of a County <br /> Service Area to be approved by the Local Agency Formation <br /> Commission prior to the approval of the Final Map, which <br /> shall become operative when the public water system is in <br /> place . <br /> 3 . Local Health District : <br /> a. This tentative division of land shall meet the rules and <br /> regulations of San Joaquin County Ordinance No . 549 . <br /> Percolation tests are to be done on each lot , and a soil <br /> profile on every third lot and a minimum sewage disposal <br /> Revised Conditions - 3 - (PC : 12-3-87) <br />
