Item No . <br /> PC : 11-19-87 <br /> SU-87-22 <br /> Page 19 <br /> EXHIBIT "A" <br /> (Subdivision No . SU-86-12 - October 20, 1987 ) <br /> Public Water Requirements <br /> 1 . The developer shall pay a fee which represents a propor- <br /> tionate share of the Master Planned Water Facilities to be <br /> used for the construction of the facilities and related engi- <br /> neering (which may include the preparation of a Master Plan <br /> for the affected area) . <br /> 2 . The fee for the construction of the Master Planned Facilities <br /> shall be $2 , 800 per lot and will be adjusted annually <br /> following the execution of the Agreement , in accordance with <br /> the Engineering News Record Cost Index. <br /> 3 . Funds collected for the Master Planned Water Facilities shall <br /> be placed in an interest-bearing trust account with the <br /> County of San Joaquin. <br /> 4 . Master Planned Water Facilities fees shall be paid for at the <br /> time of issuance of a Building Permit . <br /> 5 . The Agreement shall provide that the funds will be collected <br /> for a maximum of 15 years from the date the Agreement is exe- <br /> cuted. If the public water system is not constructed within <br /> 15 years from the date of Agreement execution, the funds, <br /> including interest , will be proportionately returned to the <br /> owner of the property at that time . <br /> 6 . In the event that the funds collected are insufficient to <br /> construct the Master Planned Water Facilities, the owner of <br /> the property will at that time be obligated to pay his pro- <br /> portionate share of the difference. In the event surplus <br /> funds are available after construction of the Master Planned <br /> Facilities, the funds with interest shall be returned propor- <br /> tionately to the owners of the proerty at that time or, at <br /> the County' s option, placed in the operating account of the <br /> County Service Area for the operation and maintenance of the <br /> system. <br /> 7 . Individual private wells, if developed for each lot on an <br /> interim basis, shall be constructed in accordance with Local <br /> Health District ' s requirements, as follows : <br /> a. A test well shall be drilled within the project area <br /> (ZR-87-34/SU-86-12 ) to determine the water quality and <br />
