Box 944212 <br /> Sacramento , CA 94244-2120 <br /> Re: SITE #2195 - LOCATION : ITALIAN SWISS COLONY WINES , <br /> 1 WEST TURNER RD . , LODI , CA 95240 <br /> Dear Sandra : <br /> This letter is a petition to the State Water Resources <br /> Control Board for relief of the excess and exorbitant fees <br /> being charged us for work and management on the contaminated <br /> soil clean up project located at the above site . <br /> Reference is made to our letter of June 4 , 1991 written in <br /> response to a cover letter and statement of charges sent by <br /> your office to us . In that letter we state we feel the <br /> project management fees assessed for time spent on our <br /> project are extremely high , completely unreasonable and out <br /> of hand . 4200 layered overhead is not acceptable at any <br /> level of purchasing or assessment . It is our understanding <br /> the legislature changed the rule and placed a $500.00 cap on <br /> administrative fees related to these projects starting <br /> January 1 , 1991 . We petition State Water Resources Control <br /> Board to recind these outrageous charges and assess the new <br /> limit , a much more reasonable figure. As stated in our <br /> previous letter , cost of clean up are already extremely high <br /> and hidden charges of this nature are a great deterrent to <br /> undertaking such a monumental task . Fees , taxes , geological <br /> reports , soil and water sampling and untold other costs have <br /> little trouble beginning to out distance the value of <br /> property . <br /> Your response to our June 4 , 1991 , letter gives a breakdown <br /> of charges and how these figures were selected . We are not <br /> disputing the fee for actual time spent , $1 ,337 .30 . Our <br /> problem is with the $5 ,620 .23 program management fees . With <br /> more charges to follow , we must wonder - when will we be <br /> finished with this seemingly never ending project? The <br /> alternative looks better every day . We probably should have <br />
