1 authorized representatives may enter and move freely about all property at the Site at all <br /> 2 reasonable times for purposes including but not limited to : inspecting records , operating logs , <br /> 3 <br /> and contracts relating to the Site ; reviewing the progress of Respondents in carrying out the <br /> 4 <br /> terms of this Consent Order; and conducting such tests as the CUPA may deem necessary . <br /> 5 <br /> 6 Respondents shall permit such persons to inspect and copy all records , documents , and <br /> 7 other writings , including all sampling and monitoring data , in any way pertaining to work <br /> 8 undertaken pursuant to this Consent Order . <br /> 9 <br /> 9 . 12 . Sampling , Data , and Document Availability : Respondents shall permit <br /> 10 <br /> the CUPA and its authorized representatives to inspect and copy all sampling , testing , <br /> 11 <br /> 12 monitoring , and other data generated by Respondents or on Respondents behalf in any way <br /> 13 pertaining to work undertaken pursuant to this Consent Order. Respondents shall allow the <br /> 14 CUPA and its authorized representatives to take duplicates of any samples collected by <br /> 15 Respondents pursuant to this Consent Order . Respondents shall maintain a central <br /> 16 depository of the data , reports , and other documents prepared pursuant to this Consent <br /> 17 <br /> Order . All such data , reports , and other documents shall be preserved by Respondents for a <br /> 18 <br /> minimum of six years after the conclusion of all activities under this Consent Order. If the <br /> 19 <br /> 20 CUPA requests that some or all of these documents be preserved for a longer period of time , <br /> 21 Respondents shall comply with that request , deliver the documents to the CUPA , or permit <br /> 22 the CUPA to copy the documents prior to destruction . Respondents shall notify the CUPA in <br /> 23 writing at least six months prior to destroying any documents prepared pursuant to this <br /> 24 Consent Order. <br /> 25 <br /> 26 9 . 13 . Government Liabilities : The San Joaquin County Environmental Health <br /> 27 Department shall not be liable for injuries or damages to persons or property resulting from <br /> 28 acts or omissions by Respondents or related parties specified in paragraph 12 . 3 , in carrying <br /> - 5 - <br /> CONSENT ORDER WESTERN FOOD AND FUEL <br />
