I out activities pursuant to this Consent Order, nor shall the San Joaquin County 2 Environmental Health Department be held as a party to any contract entered into by 3 Respondents or its agents in carrying out activities pursuant to this Consent Order. 4 5 9 . 14 . Incorporation of Plans and Reports : All plans , schedules , and reports 6 that require CUPA approval and are submitted by Respondents pursuant to this Consent 7 Order are incorporated in this Consent Order upon approval by the CUPA . 8 9 . 15 . Extension Requests : If Respondents are unable to perform any activity 9 10 or submit any document within the time required under this Consent Order, the Respondents 11 may , prior to expiration of the time , request an extension of time in writing . The extension 12 request shall include a justification for the delay . 13 9 . 16 . Extension Approvals : If the CUPA determines that good cause exists 14 for an extension , it will grant the request and specify in writing a new compliance schedule . 15 16 No extension of time is valid unless it is in a writing issued by the CUPA . 17 PAYMENTS 18 19 10 . Within 15 days of the effective date of this Consent Order , Respondents 20 shall pay the CUPA a total of $ 6 , 520 . 00 of which $ 5 , 000 . 00 is a penalty and $ 1 , 520 . 00 is 21 reimbursement of the CUPA' s costs , through the effective date . The balance of the penalty 22 amount $ 8 , 980 . 00 will be paid upon the completion of the schedule listed in paragraph 9 . Th 23 total penalty amount to be paid is $ 13 , 980 . 00 . All additional CUPA costs will be billed at the 24 25 current hourly rate .
