Eppler, PG 1501 Belvedere Road <br /> 5180 Golden Foothill Parkway, Suite 200 West Palm Beach, Florida 33406 <br /> EI Dorado Hills, California 95762-9608 <br /> Subject: CEMEX Tracy Facility (Former RMC Lone Star Kerlinger Aggregate Plant) <br /> 30350 South Tracy Blvd. <br /> Tracy, California 95376 <br /> Dear Mr. Eppler: <br /> The San Joaquin County Environmental Health Department (EHD) has received and reviewed <br /> Site Conceptual Model and Well Decommissioning Report (Report), dated 15 October 2014, <br /> prepared and submitted by your consulting firm, SOMA Environmental Engineering, Inc. <br /> (SOMA), on your behalf for the above-referenced site. In the Report, SOMA documented the <br /> destruction of monitoring well MW-4, presented results from conducting a sensitive receptor <br /> survey and contaminant fate and transport study, and evaluated site conditions in the context of <br /> the Low-threat Underground Storage Tank Case Closure Policy (LTCP) criteria. Based on the <br /> evaluation, SOMA has recommended that the site be "granted closure under the LTCP criteria". <br /> The EHD concurs that this site should be moved to closure and has discussed this case with the <br /> California Regional Water Quality Control Board Central Valley Region (Regional Board). The <br /> EHD has prepared a case closure summary to be submitted to the Regional Board for closure <br /> notification. The Regional Board will have thirty days to respond to the closure recommendation <br /> by the EHD. <br /> As required by the LTCP, "municipal and county water districts, water replenishment districts, <br /> special act districts with groundwater management authority, agencies with authority to issue <br /> building permits for land affected by the petroleum release, owners and occupants of the <br /> property impacted by the petroleum release, and the owners and occupants of all parcels <br /> adjacent to the impacted property" must be notified of the pending case closure and of their <br /> opportunity to submit comments or questions regarding the pending closure to this agency. <br /> Those to be notified include, but are not limited to, City of Tracy Water Utilities and San Joaquin <br /> County Public Works Utilities Maintenance. Comments should be directed to Vicki McCartney, <br /> San Joaquin County Environmental Health Department, 1868 East Hazelton Avenue, Stockton, <br /> California 95205-6232. Prior to distribution of the notification, please provide a copy of the draft <br /> letter to the EHD for review and comment along with the list of agencies and owners/occupants <br /> who will receive the public participation letter. An example letter is available from the EHD, if <br /> requested. The public will have sixty days to comment. <br />
