Staff <br /> have also reviewed the Case file and the reports which detail the soil and groundwater investigatiot3;tt the <br /> property. The reports contain information regarding(a)collection of soil samples,(b)detttolition of all <br /> above ground structures,(c)installation of three monitoring wells,and (d)three groundwater monitoring <br /> events. <br /> Although the initial soil samples contained elevated concentrations ofboth the oxidized and reduced <br /> forms of nitrogen, the composite sail sample coIlccted after the demolition activities were completes) <br /> contained trate}lower levels of nitrogen, 'l herefore,staff surmise that contaminated soil was removed <br /> during the demolition activities and hereby approve Cat-gill's request for no further action for the soil at <br /> this site, 'Phis approval is further justified by the probable paving of the site in the near future. <br /> Groundwater has been analyzed for nitrate, arranonia,and total dissolved solids. Nitrate is not present <br /> above levels of concent, Anunonia was found at tip to eleven times the taste-and-odor threshold. Total <br /> dissolved solids are elevated but this may be due to the proximity of the San Joaquin River and the <br /> intrusion of'connate water. Staff hereby approve Cargill's request for no further action for the <br /> groundwater at the site because the extent of contamination appeairs to be limited and docs not appear to <br /> impact the beneficial use of surrounding groundwater. However,if information presented at a later date <br /> Shows that beneficial uses are impacted due to Cargill"s past activities,then the Board may reopen this <br /> ease, As reclucsted,the three tnottitoring wells may be destroyed. <br /> Nothing in this determination shall constitute or be construed as a satisfaction or release from liability <br /> f'or any conditions or claims arising a,a result of past,current,or future operations at this location. <br /> Nothing in this.deterntination is intended or shall be construed to limit or preclude the Reginal Board or <br /> any other agency from taking Bother enforcement action.
