WASTE DISCHARGE REQUIREMENTS <br /> QUALITY ASSURED PACKING, INC. -4- <br /> STOCKTON TERMINAL <br /> EASTERN RAILROAD OF NEVADA CORP. <br /> SAN JOAQUIN COUNTY <br /> 17. The Board has reviewed the EIR. These waste discharge requirements <br /> provide protection to water quality equal to or more effective than the <br /> mitigation measure in the EIR relating to water quality. Compliance with <br /> these waste discharge requirements will mitigate or avoid significant <br /> impacts on water quality listed in Finding 14. <br /> a. Contribute to the County' s overdraft problem - The project will draw <br /> about the same amount of water out of the aquifer per acre as <br /> farming in the area. <br /> b. Ponded and leached process wastewater - Managed correctly, the <br /> disposal system will have little ponding. The soil will provide <br /> treatment of any water which does percolate. Soil and ground water <br /> sampling will monitor treatment efficiency. <br /> 18. The Regional Board finds that the EIR is fully sufficient to analyze the <br /> present project. <br /> 19. The action to revise waste discharge requirements for this facility is <br /> exempt from the provisions of the California Environmental Quality Act in <br /> accordance with Section 15301 , Title 14, California Code of Regulations <br /> (CCR) . <br /> 20. This discharge is exempt from the requirements of Section 2511(b) , <br /> Subchapter 15, Chapter 3, Title 23, CCR. <br /> The exemption is based on the following: <br /> a. The Board has issued waste discharge requirements. <br /> b. The discharge is in compliance with the applicable Water Quality <br /> Control Plan, and <br /> C. The wastewater does not need to be managed according to Chapter 30 <br /> of Division 4, Title 22, CCR, as a hazardous waste. <br /> 21 . The Board has notified the Discharger and interested agencies and persons <br /> of its intent to prescribe waste discharge requirements for this <br /> discharge. <br /> 22. The Board, in a public meeting, heard and considered all comments <br /> pertaining to the discharge. <br />
