Hazardous waste generators shall retain copies of all manifests signed off by the destination <br /> facility on site for three years and have them readily available for review. If the generator did not receive a copy of <br /> the manifest with the handwritten signature of the owner or operator of the facility to which the generator's waste <br /> was submitted within 35 days of the date the waste was accepted by the initial transporter,the generator shall <br /> contact the transporter and/or the owner or operator of the designated facility to determine the status of the waste. <br /> If the generator did not receive a copy of the signed off copy of the manifest within 45 days of the date that the <br /> waste was accepted by the initial transporter, the generator shall submit an Exception Report that includes a legible <br /> copy of the missing manifest, and a cover letter signed by the generator explaining the efforts to locate the <br /> hazardous waste and the results of those efforts. Exception reports shall be submitted to: <br /> DTSC Report Repository <br /> Generator Information Services Section <br /> P.O. Box 806 <br /> Sacramento, CA 95812-0806 <br /> Immediately locate a copy of the missing manifests or prepare and submit an exception report to DTSC. Submit to <br /> the EHD a copy of the signed off copy of the manifests or a copy of the exception report submitted to DTSC. <br /> This is a minor violation. <br /> 118 CCR 66265.16(d) Failed to maintain complete personnel training records. <br /> Employee training records for the management of hazardous waste were incomplete.Todd Teresi stated that there <br /> are five employees that manage the facility's hazardous waste.Todd provided a"Hazardous Materials Emergency <br /> Response Training" page for one employee Michael Leonard, but training must be complete and current for all <br /> employees that manage hazardous waste. Employee training records shall include: <br /> 1. the job title for each position at the facility related to hazardous waste management, and the name of each <br /> employee filling each job; <br /> 2. written job description for each position listed above; <br /> 3. written description of the type and amount of both introductory and continuing training that will be given to <br /> each person filing positions listed above; <br /> 4. records that document that the training has been given to and completed by facility personnel. <br /> Training records on current employees shall be kept until closure of the facility. Training records on former <br /> employees shall be kept for at least three years from the date the employee last worked at the facility. Ensure that <br /> employee training is properly documented. Submit complete and current training records to the EHD within 30 days. <br /> This is a minor violation. <br /> 502 CCR 66265.192(x) Failed to comply with new hazardous waste tank system assessment requirements. <br /> Facility does not have a tank assessment for the 1,000 gallon used oil tank. The owner or operator of a hazardous <br /> waste tank shall obtain a written assessment reviewed and certified by an independent, qualified, professional <br /> engineer, registered in California attesting that the system has sufficient structural integrity, is acceptable for the <br /> transferring, storing, and treating of hazardous waste, and that the tanks and containment system are suitably <br /> designed. Immediately have an assessment prepared for the 1,00 gallon used oil tank.
