document that identified commercial/industrial RBRGs are not exceeded, was <br /> approved by the Department on September 23, 2009. <br /> Based on an August 2007 Human Health Risk Assessme t (HHRH) approved by <br /> the Department on December 17, 2007 and September 2008 HHRA Addendum, <br /> all or a portion of the surface and subsurface soils within 10 feet of the surface of <br /> the Property contain hazardous substances, as defined in Health and Safety <br /> Code section 25316, which include the following chemicals of concern (COCs) in <br /> the ranges set forth below: antimony (0.6 —40 parts permillion) ("ppm")), <br /> benzo(a)pyrene (0.022 — 0.15 ppm), lead (5.6 —2,000 pp ), and 2,3,7,8-TCDD <br /> TEQ (4.9X10-7 — 9.6X10-5 ppm). In addition, there are C Cs in soil gas <br /> detected at the ranges set forth below: 1,3-butadiene (3.5 28 micrograms per <br /> cubic meter ("ug/m3"), tetrachloroethylene (9.2 — 14,000 ug/m3). Based on the <br /> Final Risk Assessment for residential land use, the Department concluded that <br /> use of the Property as a residence, hospital, school for pe sons under the age of . <br /> 21 or day care center would entail an unacceptable huma health risk. The <br /> Department further concluded that the Property, as remed ated, and subject to <br /> the restrictions of a Land Use Covenant, does not present an unacceptable <br /> threat to human health or safety or the environment, if limited to commercial and <br /> industrial, or other appropriate use. <br /> Based on these results, a covenant to restrict the property use was recorded in <br /> September 2010. <br /> 6.
