WASTE DISCHARGE REQUIREMENTS -3- <br /> THE MARLEY COOLING TOWER COMPANY <br /> STOCKTON, SAN JOAQUIN COUNTY <br /> 14. From 1 April to 1 October, flows are maintained in both the Calaveras River, <br /> as well as Upper Mormon Slough and the Stockton Diverting Canal . Numerous <br /> check dams to retain flows for irrigation supply are placed along Upper <br /> Mormon Slough, the Stockton Diverting Canal , and the Calaveras River from <br /> Upper Mormon Slough to the Stockton Diverting Canal . <br /> 15. The beneficial uses of the Calaveras River, Upper Mormon Slough, and the <br /> Stockton Diverting Canal are municipal , industrial , and agricultural supply; <br /> recreation; esthetic enjoyment; navigation; ground water recharge; fresh <br /> water replenishment; and preservation and enhancement of fish, wildlife and <br /> other aquatic resources. <br /> 16. The beneficial uses of local ground water include domestic, municipal , <br /> industrial , and agricultural supply. <br /> 17. The Board, on 25 July 1975, adopted a Water Quality Control Plan for the <br /> Sacramento-San Joaquin Delta Basin (5B) , which contains water quality <br /> objectives for all waters of the Basin. These requirements are consistent <br /> with the Plan. <br /> 18. Effluent limitation, and toxic and pretreatment effluent standards estab- <br /> lished pursuant to Sections 301, 302, 304, and 307- of the Clean Water Act <br /> and amendments thereto are applicable to the discharge. <br /> 19. The action to adopt an NPDES permit is exempt from the provisions of the <br /> California Environmental Quality Act (Public Resources Code Section 21000, <br /> et seq.) , in accordance with Section 13389 of the California Water Code. <br /> 20. The Board has notified the Discharger and interested agencies and persons of <br /> its intent to prescribe waste discharge requirements for this discharge and <br /> has provided them with an opportunity for a public hearing and an oppor- <br /> tunity to submit their written views and recommendations. <br /> 21. The Board, in a public meeting, heard and considered all comments pertaining <br /> to the discharge. <br /> 22. This Order shall serve as an NPDES permit pursuant to Section 402 of the <br /> Clean Water Act, or amendments thereto, and shall take effect ten days from <br /> the date of hearing, provided EPA has no objections. <br /> IT IS HEREBY ORDERED that The Marley Cooling Tower Company, Stockton, in order to <br /> meet the provisions contained in Division 7 of the California Water Code and <br /> regulations adopted thereunder, shall comply with the following : <br />
