WASTE DISCHARGE REQUIREMENTS -7- <br /> MARLEY COOLING TOWER COMPANY <br /> STOCKTON, SAN JOAQUIN COUNTY <br /> a. During the months of December 1987, March 1988 , June 1988, and <br /> September 1988, grab samples shall be taken once monthly of the <br /> effluent and upstream receiving water for static acute and chronic <br /> toxicity tests. These tests shall be conducted using three test <br /> species , in accordance with EPA Documents 600/4-85-014 and <br /> 600/4-85-013. The most sensitive of these species will be selected to <br /> be the test species for the chronic toxicity tests. <br /> b. Monthly and quarterly results of the toxicity tests shall be reported <br /> to the Executive Officer with the monthly monitoring reports in the <br /> format specified in EPA Documents 600/4-85-014 and 600-4-85-013. <br /> c. By 1 December 1988, the Discharger shall submit a .Technical Report <br /> containing and analyzing the results of the toxicity testing, identi- <br /> fying the sources of toxicity ( if any) , and proposing necessary <br /> measures to eliminate toxicity (if any) , in accordance with "Technical <br /> Support Document for Water Quality Based Toxics Control " , <br /> U.S. Environmental Protection Agency, September 1985. This informa- <br /> tion will be reviewed and effluent limitations may be revised <br /> accordingly. At that time, the Board may revise this Order to reflect <br /> new limitations . <br /> 7. Compliance with this Order may not relieve the Discharge of their obliga- <br /> tions under Health and Safety Code Sections 25249.5 through 25249.13, the <br /> Safe Drinking Water and Toxic Enforcement Act of 1986 (Proposition 65) . <br /> 8. The Discharger shall submit a Technical Report by 1 June 1988 containing <br /> analysis results of stormwater runoff samples from the South Yard, as <br /> described in the Discharger's 20 April 1987 Work Plan. This information <br /> will be reviewed and effluent limits may be set for the South Yard storm- <br /> water runoff. At that time, the Board may revise this Order to reflect <br /> new limitations. <br /> 9. This Order expires on 1 September 1992 and the Discharger must file a <br /> Report of Waste Discharge in accordance with Title 23, California Admini- <br /> strative Code, not later than 180 days in advance of such date as appli- <br /> cation for issuance of new waste discharge requirements. <br /> 10. In the event of any Change in control or ownership of land or waste <br /> discharge facilities presently owned or operated by the Discharger, the <br /> Discharger shall notify the succeeding owner or operator of the existence <br /> of this Order by letter, a copy of which shall be forwarded to this <br /> office. <br />
