WASTE DISCHARGE REQUIREMENTS • -6 THE MARLEY COOLING TOWER COMPANY STOCKTON, SAN JOAQUIN COUNTY 10. The discharge shall not cause a violation of any applicable water quality standard for receiving waters adopted by the Boara or the State Water Resources Control Board as required by the Clean Water Act and regula- tions adopted thereunder. If more stringent applicable water quality standards are approved pursuant to Section 303 of the Clean Water Act, or amendments thereto, the Boarb will revise and modify this Order in accordance with such more stringent standards. 11. This permit shall be modified, or alternatively, revoked and reissued, to comply with any applicable effluent standard or limitation issued or approved under Sections 301 (b) (2) (C) , and (D) , 304(b) (2) , and 307(a) (2) of the Clean Water Act, if the effluent standard or limitation so issued or approved: (a) Contains different conditions or is otherwise more stringent than any effluent limitation in the permit; or (b) Controls any pollutant not limited in the permit. The permit as modified or reissued under this paragraph shall also contain any other requirements of the Act then applicable. E. Provisions: 1. Neither the discharge nor its treatment shall create a nuisance or pollu- tion as defined in Section 13050 of the California Water Code. 2. The Discharger shall comply with the "Standard Provisions and Reporting Requirements (NPDES)", dated 15 May 1986, which are part of this Order. 3. The Discharger shall comply with the attached Monitoring and Reporting Program No. 87-161. Once sufficient data have been collected, the Dis- charger shall submit a Technical Report regarding the monitoring fre- quencies and constituents in the Monitoring and Reporting Program. The Board will review the Report and may revise the Monitoring and Reporting Program as appropriate . 4. This Order rescinds Order No. 86-004 (NPDES No. CAO081787), adopted by the Board on 24 January 1986. 5. The Discharger shall submit a Technical Report before 1 April 1988, which determines treatment plant influent ground water concentrations and the treatment efficiencies for the constituents of concern. The Report shall also describe any physical or operational changes to the treatment plant necessary to meet effluent limits. The Board, at a public hearing, will review and consider modifications to the Effluent Limitations. 6. An effluent toxicity program shall be implemented by 1 December 1987, which consists of the following tasks:
