Russell and Ericson: <br /> On behalf of DeltaKeeper, WaterKeepers Northern California and the California Sportfishing <br /> Protection Alliance (hereinafter DeltaKeeper), thank you for this opportunity to comment on the <br /> Tentative Permit(Permit) for the Marley Cooling Tower Company, Groundwater Extraction and <br /> Treatment System. We note that the present Permit expired on 22 October 1998 and that it has <br /> taken staff an additional four years to issue a tentative renewal. These initial observations will likely <br /> be supplemented with more extensive comments. <br /> The Calaveras River and Stockton Diverting Canal are habitat and migration corridors for a number <br /> species protected under federal and state endangered species acts. Species include: Central Valley <br /> spring-run chinook salmon (Oncorhynchus tshawyrscha-federal and state listed as threatened); <br /> Central Valley steelhead(Oncorhynchus mykiss -federal listed as threatened); Delta smelt <br /> (Hyponzesus rranspacificus- federal and state listed as threatened); Sacramento splittail <br /> (Pogonichthys macrolepidotus -federal listed as threatened, California species of concern). <br /> The National Marine Fisheries Service (NMFS) has identified the Delta and it,; tributaries, <br /> including local waterways as "Critical Habitat." 65 Fed. Reg. 77647787 16 Feb 2000 <br /> (designating critical habitat for the Central Valley spring-run chinook salmon and Central Valley <br /> steelhead). The United States Fish and Wildlife Service(USFWS) has likewise identified the Delta, <br /> its tributaries and local waterways as "Critical Habitat."59 Fed.
