In the training area,a box was observed containing: -Six 7oz containers labeled"Genuine Water Pump Lubricants" -One 1 quart container labeled"VTM-4 Differential Fluid" -Three aerosols cans used for cleaning The manager was not sure if the containers were a waste. Any person who generates a waste shall determine if the waste is a hazardous waste. Immediately, make a hazardous waste determination for all of the wastes,and manage them according to Title 22 hazardous waste regulations. Submit a statement and supporting documentation explaining how these items were managed, This is a minor violation. 104 CCR 66262.34(d)(2)No modified contingency plan. An emergency coordinator was missing from the contingency plan. There must be at least one emergency coordinator on site or on call to coordinate emergency response measures,and the following information must be posted by a phone:the name and phone number of the emergency coordinator; location of fire extinguishers, spill control equipment, and if present,fire alarm; and the phone number of the fire department,unless the facility has a direct alarm. Immediately amend the contingency plan and submit the amended portion to the EHD for review. This is a minor violation. / 110 CCR 66262.40(a) Failed to keep signed copy of manifests from the designated facility for three years. According to Ben Dabalos, used oil was recently picked up. The disposal record was not found on site. Hazardous waste generators shall retain copies of all manifests signed off by the disposal facility and all receipts used in a consolidated manifesting procedure on site for three years and have them readily available for review. Immediately locate a copy of the missing disposal record,maintain it on site, and submit a copy to the EHD. This is a Class II violation. 113 HSC 25160.2(b)(3) Failed to keep copies of consolidated manifesting receipts for three years. Copies of hazardous waste disposal records for used oil and oil filters from the forklifts were not found on site.The forklifts are serviced by Watts. If the used oil is being taken with the service company,the following documentation needs to be kept for the facility to show that the repair business is following California Health and Safety Code Section 25250.12 under Article 13 of Management of Used Oil: -The amount of used oil generated showing that no more than 55 gallons is transferred in the vehicle at any one time. -The name and address of where used oil is being transported to. -The date the used oil is generated. Used oil filters need to be managed according to hazardous waste laws and regulations.
