! • <br /> Mr. Arnold Hof - 2 - 6 February 2004 <br /> Delinquent Reports <br /> We have not received the first or third quarter monitoring reports that were due on 1 May 2003 and <br /> 1 November 2003 as required by MRP No. 97-812, we have not received word that you have applied for <br /> destruction of monitoring wells MW-8 and MW-9, nor have we have received any documentation <br /> regarding the trees you agreed to plant near MW-3. We are disappointed that you are not working with <br /> your consultant or with us in spite of our collective efforts to reduce your monitoring and remediation <br /> costs. <br /> You are required to sample the monitoring wells in the first quarter (January-March) 2004 and <br /> provide a monitoring report by 1 May 2004 in accordance with MRP No. 97-812, which is still in effect. <br /> When we receive the first quarter monitoring report, we will transmit the new MRP that will reduce the <br /> scope and frequency of monitoring. <br /> The MRP is issued under Section 13267 of the Porter Cologne Water Quality Control Act. Failure to <br /> comply with the MRP can result in the assessment of monetary penalties up to $1,000 per day per <br /> offense. To date, the report that was due 1 May 2003 could cost you$280,000 and the report that was <br /> due 1 November 2003 could add an additional $98,000. You can avoid these penalties by complying <br /> with the MRP now. There is still time to obtain the first quarter 2004 monitoring samples. <br /> By 30 March 2004 you must sample the monitoring wells according to existing MRP No. 97-812,by <br /> 16 April 2004 you must destroy off-site monitoring wells MW-8 and MW-9, and by 1 May 2004 you <br /> must provide a report that contains the following: <br /> • a semi-annual monitoring report containing the monitoring results and all the information required in <br /> MRP 97-812; <br /> • documentation of the monitoring well destruction including copies of appropriate permits issued by <br /> San Joaquin County Environmental Health Department; and <br /> • documentation of tree planting activities including photographs and a site map identifying the tree <br /> locations. <br /> Failure to meet these deadlines will result in my recommendation for an enforcement action that could <br /> lead to monetary penalties.
