10. Without limiting the generality of the foregoing provisions,prior to entering the <br /> Subject Property, Licensees, including their contractors and agents, shall <br /> familiarize themselves with the location of the Subject Property and the location <br /> of any and all Facilities(as defined below) located thereon. After conducting its <br /> work,Licensees shall restore the Subject Property and improvements located on <br /> the Subject Property to substantially the same or a better condition than exists on <br /> the date of this Agreement. Licensees agree not to bring onto the Subject <br /> Property any truck or other equipment whose weight exceeds the load capacity of <br /> the paving on the Subject Property. In the event that existing monitoring wells or <br /> other permitted or allowed structure or facilities ("Facilities")are utilized,the <br /> same shall be returned to substantially the same or a better condition than exists <br /> on the date of this Agreement. If a Facility is to be abandoned or closed under <br /> permit and with the consent of Licensor,Licensees shall notify Licensor in <br /> advance of the work and apply for, obtain from the agency with jurisdiction,and <br /> complete the work according to the terms of the permit. Licensees agree that they <br /> shall properly abandon or close all of the borings installed on the Subject Property <br /> pursuant to the Work Plan after obtaining all required permits and authorizations. <br /> 11. Licensees hereby confirm that Licensor will have, at a minimum, a"one-way" <br /> entrance and exit to the Subject Property throughout the performance of the work <br /> pursuant to the Work Plan. <br /> 12. This Agreement shall be binding upon and shall inure to the benefit of the heirs, <br /> successors and assigns of the Parties. <br /> 293554.1 <br />
